Entrepreneurs - Who Gets to Keep the Website After You Divorce Your Webmaster?

Attention all business owners! Do you know the answer to this question: Who gets to keep the website after you divorce your webmaster?

Just like in a marriage, it all depends on the pre-nuptial agreement (contract). Do you have one?

My personal disclaimer: Some of this information may be about legal issues; however this article is not intended as a substitute for legal advice. I am not an attorney nor do I play one on webTV therefore you should consult with an attorney familiar with the laws concerning internet and intellectual property.

Ok, now on with the story, the short version. . .

Here's the situation, for whatever reason the client decided not to pay their annual bill for web hosting services. Even though there were several attempts to reach the client the bill went unpaid for more than 90 days. As a result, the hosting was cancelled and the site was removed from the server.

Several months later the client sent this exact message: "you have my website and I need you to let me know how to get it back, like I said before I paid you money to build it so....? that money had nothing to do with hosting or anything".

Just because you paid for the development of your website does not mean you own it. There are Intellectual Property laws designed to protect the creator and to encourage the creator to create. If you hired a company they own the software development and website design produced by its employees. If you hired an independent contractor you must obtain a written "assignment" of the copyright in the commissioned work from them.

Most business owners unknowingly give their webmaster complete control over their business website. Even if you don't have a pre-nuptial agreement (contract) or own your website you can still maintain some control. While you and your webmaster are honeymooning be sure you can document the answer to these questions:

1. What software was used to develop the website?

  • Exact name
  • Version
  • Software website

2. How to access the code?

3. Where is the code located on the server?

4. How to change the content?

  • Graphics
  • Text

5. How to create a weekly back up?

6. How to grant access to additional users?

7. How to obtain the master copies of your website design?

As a business owner, how many people realize their webmaster is like their spouse? Voluntarily joined for life (or until divorce), not many! Just like in marriage a prenuptial agreement (contract) is a practical solution to dealing with the risks and problematic topic of who gets to keep the website after your divorce.

Web Marketing and the Potential in a Multi-Site Design

The concept of web development may include more than a singular ecommerce website.

I have talked about the subject of web development in light of positively constructing a website. I've also talked about the mentality needed to envision the entire site prior to launch so you have some idea of where you want to go. The goal also included the need for a plan for growth and site expansion.

This article looks at the subject from the point of view of a corporate office with a few satellite offices that support and expand the potential of the primary business.

In a brick and mortar store environment it is often true that a business will start in a singular location. As trust is built through longevity and commitment to quality and service the business grows. If the business does well the owner may decide to develop a second store in another city within the region of primary service and support. Other stores may be opened as a result of the ongoing success of the overall operation. The idea is multiple stores - one brand.

Web development may be the mirror image of the brick and mortar model. Why do I say mirror? Well, because in the case of an online environment an ecommerce business owner may be better served by starting with the secondary stores and building up to the primary online business portal.

If you're thinking, "That does seem backwards," allow me to explain.

These satellite stores should have direct links to your primary site. Each satellite may have its own emphasis, but will always relate to the thrust of your main business. The end goal remains the same, multiple stores - one brand.

Why develop more than one site?

In web development the idea of more than one site could mean improved site rankings for your primary site and additional opportunities to reach potential customers.

Think of it this way. Each satellite website you develop can take on a distinct list of keywords or phrases. Each will be associated with your primary product. All content on the site will be geared toward the specific keyword or phrase.

If you have four supporting sites that can go online at the same time as your primary site you have five distinct opportunities to reach consumers with your message. Work to optimize each site for search engines and select unique and researched keywords or phrases for each site.

Is that the only benefit?

By developing your web presence this way you begin the process with backlinks already in place from the satellite sites to your primary web presence. As your Search Engine Optimization (SEO) strategies begin yielding results they should do so in all five instances and ultimately this effort benefits your bottom line.

By having five separate sites that market the same product from a slightly different vantage point the potential improves for increased sales. This is true not just because there are more sites for consumers to view, but because search engines will connect with this scenario and provide improved rankings earlier.

Proper web development may include more than one site and more than one approach as the vehicle used to maximize the overall potential of the product or service being marketed.

Everyone Is Talking Web 2.0 Development

In layman language Web 2.0 means the second generation of web development. The first generation web development is considered to be the great dot-com bubble of late 90's and the rupture of which around late 2001 triggered ubiquitous reactions that the Web was over hyped. Concept of second generation of Web development started after a media conference between O'Reilly and MediaLive International. In this brainstorming session it was realized that the web has thrown up more interesting applications and Web technology has emerged more important that ever and the word Web 2.0 was coined. Web 2.0 is a business revolution making a bent towards the web as a platform. Web 2.0 doesn't have a definite boundary and there are several things encompassing a core. Web 2.0 is visualized as principles and collection of numerous sites running on those principles at some distance from the core.

Since then Web 2.0 has remained a top level discussion for proper definition and boundary that is yet to be reached. One can simply say blogs, social bookmarking, wikis, podcasts, RSS feeds, and lightweight business over a single platform. Web is no more one way, now uploading, and downloading of information happens simultaneously, sharing and distributing contents across networks leveraging the power of "Long Tail".

Web 2.o includes numerous practices. Here are some typically implemented practices by websites:

• Well-off internet applications based on Flex or Ajax.
• This intend to allow information intended for end-users, such as contact information, calendar events, geographic coordinates, content life, social relationships etc
• Presentation is separated from content through Cascading Style Sheets (CSS).
• High-end APIs (Application programming interfaces).
• Content Syndication through RSS or Atom.
• Facility for content creation through users, also by machines from client side or server side.

Content Syndication: Syndicating partial or whole content through standard protocols such as RSS, Atom, and RDF by using XML so as to be used by the end-users for their need.

Some misconceptions on Web 2.0:

• Curvy designs (This curvy structures became widely popular at the same time, designers also started making more websites with this cool looking styles)
• Use of Ajax or Flex (Which happens to come in the same time of Web 2.0, No doubt that websites with web 2.0 architecture needs these to work well.)

Web 2.0 is not an alien to criticism and had its fair share. Here are some criticisms leveled at Web 2.0

• Web 2.0 is not a new version of World Wide Web at all. It merely uses the technologies and architectures of Web 1.0.
• Ajax is not substituting the HTML protocol; it's an additional layer over HTML.
• Blogs or social networking was features of Amazon.com since 1995 when the word called Web 2.0 dint exist. It's way more than only blogs and social networking.
